To procure investment through the EB-5 Visa Program, American businesses must meet certain requirements.
Requirement #1 – New Commercial Enterprise
All EB-5 investors must invest in a new commercial enterprise, which is a commercial enterprise that was:
- Established after Nov. 29, 1990, or
- Established on or before Nov. 29, 1990, that is:
- Purchased and the existing business is restructured or reorganized in such a way that a new commercial enterprise results, or
- Expanded through the investment so that a 40-percent increase in the net worth or number of employees occurs
Requirement #2 – Capita l Investment Requirements
- $500,000 in Targeted Employment Area (High Unemployment or Rural Area).
- $1,000,0000 in any other region.
- The investment must be at risk.
Requirement #3 – Job Creation Requirements
Create or preserve at least 10 full-time jobs for qualifying U.S. workers within two years (or under certain circumstances, within a reasonable time after the two-year period) of the immigrant investor’s admission to the United States as a Conditional Permanent Resident.
Requirement #4 – Investor’s Source of Funds
Other than specified amount of investment according to the feature of projects, EB-5 Visa has minimal requirements on foreign investors. It does not have language or education requirements, for example. However, USCIS does require investors to provide detailed information on the “lawful source of funds” and the “paths” for acquiring funds.
